Welcome to ask-dwight.com and its subdomains. These Terms of Service ("Terms") govern your access to and use of ask-dwight.com and all its subdomains, including app.ask-dwight.com (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

The Service provides an AI-powered sales assistant designed to help users improve their sales processes and outcomes. The Service includes features such as sales conversation analysis, recommendations, and related functionalities.

3. User Accounts

To access certain features of the Service, you must create an account using Google authentication. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to:

  • Provide accurate and complete information when creating your account

  • Update your account information as necessary to maintain its accuracy

  • Immediately notify us of any unauthorized use of your account or any other breach of security

4. User Content

You retain ownership of any content you submit, upload, or display on or through the Service ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, copy, modify, create derivative works based on, distribute, publicly display, and publicly perform your User Content for the purposes of operating and improving the Service.

5. Prohibited Uses

You agree not to:

  • Use the Service in any way that violates any applicable law or regulation

  • Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service

  • Use the Service for any purpose that is harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable

  • Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity

  • Engage in any activity that interferes with or disrupts the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Ask-Dwight, LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

8. Limitation of Liability

In no event shall Ask-Dwight, LLC, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from:

  • Your use of or inability to use our Service

  • Any unauthorized access to or use of our servers and/or any personal information stored therein

  • Any interruption or cessation of transmission to or from our Service

  • Any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our Service

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
